Welcome to Gary Barnes International (“Gary Barnes International,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of our website, programs, coaching, events, subscriptions, and related services (collectively, the “Services”). By accessing or using our Services, you agree to these Terms.

1. Who We Are
Gary Barnes International provides business coaching, mastermind programs, events, workshops, speaking engagements, and related educational experiences designed to support personal and professional growth.
2. Eligibility
To use our Services, you must:
Be at least 18 years old
Have the ability to enter into a binding contract
Agree to these Terms and our Privacy Policy
3. Services We Provide
Our Services include:
Business and personal development coaching
Virtual and in-person mastermind groups
Workshops, intensories, and live events
1:1 coaching
Group coaching programs
Subscription-based programs
Payment-plan based programs
From time to time, we may update, improve, or change the format or content of any program or event. We may also reschedule or modify sessions as needed.
4. Payment Terms
When you enroll in any program, event, coaching package, or subscription, you agree to:
Pay all fees associated with your enrollment
Ensure payment information is accurate and up-to-date
Authorize us or our payment processor to charge your card for recurring payments, payment plans, or subscription renewals
Payment plans and subscriptions continue until completed or canceled according to the specific agreement for that program.
If a payment fails, you authorize us to automatically retry the charge and/or use any other payment method on file.
5. Chargebacks Are Not Permitted
Because our programs and events involve substantial preparation, planning, and reserved capacity:
You agree not to initiate a chargeback for any payment made to Gary Barnes International.
If you believe a charge was made in error, contact us directly at [email protected] so we can resolve the matter promptly.
Improper chargebacks may be treated as a breach of contract.
6. Recordings, Media, and Photography
By participating in our coaching calls, events, or programs, you understand and agree that:
Sessions (virtual or in-person) may be audio- or video-recorded
Group coaching calls may be recorded for training or client access
Events may be photographed or filmed
Your name, voice, image, likeness, and testimonials may be used for educational or marketing purposes
You grant Gary Barnes International a perpetual, worldwide, royalty-free license to use these materials in any lawful way.
If you prefer not to appear in marketing footage, please notify us before the event or session.
7. Your Responsibilities
You agree to:
Use our Services lawfully and respectfully
Not share access links, materials, or recordings with others
Not reproduce, distribute, or modify our content without written permission
Not disrupt sessions, events, or group environments
Participate in a professional, constructive manner
We may suspend or remove access for behavior that disrupts the learning environment.
8. Intellectual Property
All program materials, exercises, recordings, worksheets, videos, and content on our website or within our coaching programs are the exclusive property of Gary Barnes International.
You receive a limited, non-transferable license to use materials for your personal use only.
You may not:
Share access credentials
Reproduce or distribute our materials
Teach, sell, or repurpose our content
Publish or post any portion of our proprietary programs
Violations may result in legal action.
9. No Professional Advice
Our programs provide education and coaching. We are not providing:
Legal advice
Financial or investment advice
Medical, psychological, or therapeutic advice
All decisions and results are your responsibility. Coaching does not guarantee any specific outcome or financial result.
10. Assumption of Risk for Events
If you attend an in-person event, you acknowledge and agree that:
You assume all risks associated with travel and event participation
Gary Barnes International is not responsible for injury, illness, lost property, or travel delays
You are responsible for your own health, decisions, and conduct
You release Gary Barnes International from liability for any claims arising from event participation.
11. Technology and Third-Party Services
Our website and programs may rely on third-party platforms such as Zoom, Kajabi, payment processors, or email providers.
We are not responsible for:
Outages
Technical issues
Platform errors
Security breaches from third-party platforms
We will do our best to ensure smooth delivery.
12. Privacy
Your use of our Services is also governed by our Privacy Policy.
Please review it to understand how we collect, store, and use your information.
13. Disputes, Arbitration & Governing Law
To keep matters efficient and fair, you agree to the following:
13.1 Binding Arbitration
Any dispute arising out of or relating to these Terms or our Services will be resolved through binding arbitration, not court.
13.2 No Class Actions
You agree that disputes must be resolved individually—not as part of any class or group.
13.3 Governing Law
These Terms are governed by the laws of Colorado, without regard to conflict-of-law principles.
13.4 Venue
If any court involvement becomes necessary, venue will be exclusively in Denver County, Colorado.
14. Limitation of Liability
To the fullest extent permitted by law:
We are not liable for indirect, incidental, special, or consequential damages
We do not guarantee outcomes, results, or earnings
Our total liability will never exceed the total amount you have paid to Gary Barnes International in the 12 months prior to a claim
You are fully responsible for your decisions and outcomes.
15. Indemnification
You agree to indemnify and hold Gary Barnes International harmless from any claims, damages, losses, or expenses arising from:
Your use of the Services
Your violation of these Terms
Your actions, decisions, or behavior in programs or events
